Welcome to Bharat Ek Nayi Soch Advertising (“BENS”, “we”, “our”, or “us”). These Terms and Conditions govern your use of our website (ad.bharateknayisoch.com) and the advertising services we provide. By submitting an inquiry, booking an ad campaign, or using our Live Ad-Tracker, you (“Advertiser”, “Client”) agree to be bound by these terms.
1. The BENS “Zero-Risk” Advertising Model
We operate on a unique, transparent Pay-Per-View (PPV) model powered by our proprietary Live Ad-Tracker. The following strict rules govern all billing and performance metrics:
- The 2-Lakh View Cap (Volume Protection): To protect the Advertiser’s budget, the maximum billable views for any single sponsored video or banner integration is strictly capped at 200,000 views. If a video goes viral and exceeds this limit, any additional views generated are provided 100% free of charge. The Advertiser will never be billed for more than 200,000 views per integration.
- The 30-Day Billing Freeze (Time Protection): The billing cycle for any campaign is strictly limited to 30 days (720 hours) starting from the exact time of the video’s publication on YouTube. After exactly 30 days, the billing meter freezes permanently. Any views accumulated on the 31st day and beyond are complimentary and will not be invoiced.
2. Live Ad-Tracker & Data Accuracy
- Single Source of Truth: All billing is calculated exclusively based on the data pulled directly from the official YouTube API into our Live Ad-Tracker dashboard.
- Transparency: Advertisers will be provided a “View Only” link to their specific campaign dashboard to monitor views and costs in real-time.
- Dispute Resolution: Because our data is fetched directly from YouTube’s official API, we do not accept third-party analytics screenshots or estimates as a basis for billing disputes. The BENS Live Ad-Tracker numbers are final.
3. Payment Terms & Invoicing
- Rates: Advertising rates (Cost Per View) are fixed as per the finalized agreement and rate card selected during booking (e.g., Main Banner, Retention Banner, Mid-Roll, etc.).
- Advance Payment: A minimum advance payment may be required to secure the slot and initiate the campaign, as detailed in your custom proposal.
- Final Invoice: The final invoice will be generated either when the video hits the 2-Lakh View Cap OR when the 30-Day Freeze period ends (whichever occurs first).
4. Content Guidelines & Approvals
- Right to Reject: BENS reserves the right to reject any advertising material that is misleading, fraudulent, offensive, or violates YouTube’s Community Guidelines.
- Brand Synergy: We ensure that all promoted products align with the trust and values of the Bharat Ek Nayi Soch community. We do not promote gambling, explicit content, or unverified financial schemes.
5. Limitation of Liability
- Performance Guarantee: While we guarantee the precise tracking of views and strict adherence to the budget caps, BENS does not guarantee specific sales, clicks, app downloads, or conversion rates. The Advertiser is solely responsible for the quality and appeal of their product/service.
- Platform Outages: BENS is not liable for temporary tracking delays caused by YouTube API outages or Google server maintenance.
6. Cancellations and Refunds
- Pre-Production: Campaigns cancelled before the ad integration has been recorded or edited may be eligible for a refund of the advance amount, minus processing fees.
- Post-Publication: Once a video containing the ad integration is published on the BENS YouTube channel, no refunds will be issued under any circumstances.
